Jury selection began today in People of the State of California v. Anthony Nicholas Orban (San Bernardino County, Case No. FWV1000794), where the former marine and Westminster Police detective is being prosecuted for multiple charges stemming from the April 3, 2010, alleged armed kidnap, rape, and sexual assault, of a woman at the Ontario Mills Mall. As he struggled to cope with the effects of P.T.S.D., Orban was prescribed a combination of the drugs Zoloft and Neurontin.

James E. Blatt, who is known for his creative defense strategies and creating new defenses in the area of criminal law, contends that Mr. Orban?s crime, was the result of a Zoloft-induced psychosis. ?Due to his use of the prescription drug known as Zoloft, my client suffered a psychotic break from reality where he could not comprehend his actions and did not know right from wrong? stated Mr. Blatt, who then went on to say, ?Had it not been for the use of Zoloft, this crime would not have occurred.?

Mr. Blatt stated that Orban had no prior criminal record before the sexual assault and suffered from P.T.S.D after returning from Iraq and that he had been “overprescribed” with the anti-depressant Zoloft and anti-seizure medication Neurontin. Blatt said Orban’s wife and other relatives, colleagues, and friends are completely shocked at the charges filed against the former Marine and Iraq War veteran and will continue to stand by him during the trial.

Westminster Police Chief Mitch Waller also stated to the OC Register (Published: April 9, 2010) that Orban had always been a good officer with an exemplary record who was recently promoted to detective. “Since we found out about this, we have been compelled to go back to his employment record, background record and polygraph test results,” Waller said. “We are checking to see if there were any red flags we missed, and we haven’t seen any.?

Crimes of random violence by police officers are unusual, an expert said. “It’s statistically bizarre to have an officer assault a woman in broad daylight and rape her like this case alleges,” said Ronald Huff, a criminologist at UC Irvine. “This is really rare.” (Published: OC Register April 9, 2010)

San Bernardino County Deputy District Attorney Deborah Ploghaus will be prosecuting this case and believes that Orban?s duty was to protect and serve, as she stated to the OC Register (Published: April 9, 2010). “The crime is a random act of violence that could have happened to anyone, which is scary enough, but the fact it was committed by an off-duty officer, whose job it is to protect the public from crimes, makes this case especially horrific.”

Anthony Orban?s trial is expected to last six weeks, and is being heard in the Rancho Cucamonga Superior Court, Department 7, before the Honorable Judge Shahla S. Sabet.

yes you can get that expunged but its pretty tough but you can

First of all you must complete your sentence in full. If you are sentenced to serve jail time, for instance, you must complete all jail time prior to expunging your felony. If you have multiple charges they may either run concurrent or consecutively. If you are released early for any reason (overcrowding, good behavior, etc.) you are considered to have served all of your time.

You must complete all of the terms of your probation successfully. This may include reporting to the court or a probation officer monthly for a period of time, paying back a fine to the court, paying restitution, etc. All of these terms should be clearly spelled out by the court at the time of your sentencing.

Beyond the period of probation you must establish for the court a pattern of good behavior. Usually this needs to be for at least three or four years – this is not a fast process. You need to stay out of all criminal behavior – anything (except a minor traffic offense) could jeopardize your chance of expunging your felony.

After establishing a period of good behavior, you must appeal to the court to have your felony expunged. This should be in a letter outlining everything you have done to right your wrong and ensure that you will never break the law again.

The final step is waiting for the judge to approve your expungement. This can take a long time and requires a lot of patience, but in the end you will be glad you went through the process of clearing your record.

If it were up to me I would allow the cops to shoot people who ran from them because if you run you did something wrong so they should be allowed to shoot runners just my opinion.

Question by : Can any active or retired police officers help me with this problem?
I’ll start by saying that this is about my father and not me. My father is a retired disabled police officer who is going through a lot of stress. About two years ago while on a traffic stop he was hit by a DUI(Marijuana) and was forced to have his ankle and his neck fused. This obviously forced him to retire on disability since he can’t move his ankle or neck. He put in 22 years of service and loved his job so much that it inspired me to pursue my dream of becoming a police officer. He has won numerous awards (four federal police officer recognition awards, 6 state police officer recognition awards, and 7 county top cop awards). I’ve noticed that for the past two years he has been down. I finally sat down with him the other day and talked to him and asked if everything was alright and he said it wasn’t. He told me how he misses the job and that it wasn’t a job to him but a way of life. I can see he misses it and it depresses me to watch him like this. I was wondering if any active or retired police officers with this unfortunate experience has any advice. Thank you and be safe.

Where do you live. In my county they have several positions that are either part time or VIP (volunteers in policing). The part time position like working the the dispatch taking calls, helping out working a front desk there has to be something. He will never carry a gun or have arrest powers again but there has to be something some local or county agency has for him to do. If not, maybe its time to figure out how to start a program at a local agency. I retired 2 years ago, and am going back part time working inside. It gives me something to do.

North Carolina Police Benevolent Association announces support for NC Supreme Court and Court of Appeals candidates

Along with the previous endorsements, the PBA has also announced their support for candidates running for NC Supreme Court and Court of Appeals. The PBA?s endorsement of judicial candidates continues to be the most comprehensive and successful process of any law enforcement association effort. PBA endorsed judges continue to make landmark decisions that are improving conditions for North Carolina law enforcement officers. The NCPBA believes that while federal courts were once the primary forum for adjudicating constitutional and civil rights claims of law enforcement officers, federal courts have become hostile to officers in many areas of law. PBA attorneys have had great success in bringing PBA cases to North Carolina courts. As a result, there have been some enlightening decisions which have opened doors for application of the North Carolina Constitution in the state courts. Before these efforts, very few, if any, state constitutional claims were being considered regarding the application of the North Carolina Constitution to protect the rights of North Carolina police officers. As a result, more judicial candidates are better versed on the importance of the North Carolina Constitution and its potential for impact on the law enforcement profession.

This year?s Supreme Court and appellate races include many outstanding candidates who expressed genuine respect of the law enforcement profession and clear understanding of how the North Carolina Constitution protects the rights of law enforcement officers. Candidates seeking the PBA endorsement met with a screening committee to discuss the following issues: state constitutional claims; constitutional interpretation; due process; Equal Protection Clause of the 14th Amendment; privacy of law enforcement personnel files; and First Amendment protection for law enforcement officers. Based on the screening committee?s recommendations and a vote of the Division board, the PBA chose to endorse the following candidates for the primary election on May 8th.

If you can sponsor yourself through a police academy, it would be advisable to do so, as you will be marketable. However, law enforcement agencies tend to accept candidates with a bit of “life experience.” Applying directly out of high school may be a problem for some agencies.

The pay scale and promotions vary from department to department and you will likely have to ask the specific agency you wish to work for about those issues.

Police jobs in general are sought after positions and tend to be competitive. I would expect a series of tests, such as a medical, psychological, physical, a written test and an interview.

Meeting certain physical fitness standards is usually a requirement to get a job as a police officer. On the job, it can be physically demanding at times and you should expect to run and/or physically engage people to gain control/compliance.

The average length of a police career is about 25-30 years.

The police academy teaches a vast amount of topics, some of which are: Criminal Law, Physical Defense, Traffic Law, Firearms, Vehicle Operations and a lot of other topics related to law enforcement in general.
